1. Use any image submitted for any media purposes, we find worthy of creating to raise funds for the vicitms who suffered loss during the flood in Bartholomew County.

D. You understand and agree that if you submit any photo orally or written to be placed on Columbus Indiana Flood 2008 site, or in any publications it becomes property of the Columbus Private Network and will be will be used based on the following:

1. Photos submitted may or may not be placed on to the current production DVD, or in any future publications including but not limited to; Books, Posters, Picture CD’s, Video tapes, or any other type of media for the sole purposes of raising money for the flood victims.

• *If costs of productions do not raise money for the flood victims due to the cost of creation then no donations will be given.

1. All Photos submitted will be placed online for the public to see, Columbus Indiana Flood 2008 does not edit or remove any images once submitted.
2. If we use your photos for the current production of the DVD or any publication including to but not limited to: Books, Posters, Picture CD’s, Video tapes, or any other type of media for the sole purposes of raising money for the flood victims credit will be given to the name submitting the photos.
3. Columbus Indiana Flood 2008 does not use photos from image hosting accounts unless exclusive permission from the owner is given, and image quality is good for displaying, and for use on the DVD or on the Columbus Indiana Flood 2008 site or any future publications in any form.
4. Columbus Indiana Flood 2008 will use images from emails that have been sent to bulk recipients, if credit can’t be given to originator of photo then credit will be given to person emailing photos. Please note mass emails containing images of the Flood that took place in 2008 are shared among the internet and you may claim them but they will not be removed from the site. , at any time rules to this section can and will be added at our discretion. Columbus Indiana Flood DVD 2008 may at anytime sell or create new items that will make money for specific charity listed at time of event, online, or through a reseller.
5. Columbus Indiana Flood 2008 site and Columbus Private Network in whole has a sole purpose to document history and all images submitted will be used for this purpose in all publications.

E. You understand all proceeds earned (if any) from the sale(s) of DVD(s), Poster(s), Book(s), Image(s) will be donated to said charity once all accounting has been completed.

F. You understand if you purchase any product from this site, events, stores, person, that all checks must be made payable to Photolicious Keepsakes and all credit card transactions be paid through PayPal. If you accept a DVD, book, poster, Cd’s, or any media related to this site, and chose to pay said charity directly and not pay said seller then you will be charged with theft, or DVD will need to be returned.

F. You understand that Materials are copyrighted and owned by Columbus Indiana Flood 2008 and it’s submitters only, and any unauthorized use of any of these Materials by you may be an infringement upon said copyright.�

G. Columbus Indiana Flood 2008 and all Materials are made available to you AS IS, AS AVAILABLE, and WITH ALL FAULTS. Columbus Indiana Flood DVD 2008 its volunteers, directors, and officers and anyone else associated with Columbus Indiana Flood 2008 makes no representation or warranty, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement.  Columbus Indiana Flood 2008 further makes no representation or warranty that your usage of Columbus Indiana Flood 2008 will be uninterrupted, error free of computer viruses, or other damaging materials.�

H. You agree to fully, indemnify, and hold harmless Columbus Indiana Flood 2008, its volunteers, directors, officers, and any other entity associated with Columbus Indiana Flood 2008, and each  of its successors, licensees, and assigns free and harmless from any and all claims, liabilities, costs, losses, damages, expenses, including attorneys fees and expenses, arising in connection with Your use of the Materials and this website or of any breach or alleged breach of any representation, warranty, or other promise made by You in this Agreement.

K. ENTIRE AGREEMENT. You acknowledge that this agreement expresses the parties entire understanding and agreement, and that there have been no warranties, representations, covenants, or understandings made by either party to the other except as expressly set forth in this agreement.  Any modifications to this agreement shall be made in writing and agreed to by both parties in writing.  The parties further acknowledge that this agreement supersedes, terminates, and otherwise renders null and void any and all prior or contemporaneous agreements or contracts, whether written or oral, entered into between the Buyer and Seller and Submitter with respect to the matters expressly set forth in this agreement.

L. You agree, attest, and reaffirm your agreement to the terms listed herein and to conduct your transaction electronically.
